From June 15, 2024, until September 15, 2024, the UAE Ministry of Human Resources and Emiratisation (MoHRE) is planning to implement the Midday Break, a countrywide restriction on working in direct sunlight or in open-air settings, from 12:30 to 3:00 pm.
For the twentieth year, the Break is an important part of the country’s labor market rules. Its stated goal is to safeguard employees from heat-related illnesses by creating a workplace that follows all applicable regulations and guidelines for occupational health and safety.
“Implementing the Midday Break has become a deeply ingrained culture in the UAE’s business community and among private-sector companies in the country, given its role in ensuring the health and safety of workers, who we consider to be the most valuable resource of any company,” His Excellency Mohsin Al Nassi, Assistant Undersecretary for Inspection Affairs at the MoHRE, said.
“The commitment we have seen from companies to implementing the Break over the past years reflects the deep sense of awareness, partnership, and social responsibility in the business community, underlining their dedication to implementing all regulations concerning workers’ protection and safety,” He added.
Due to technology concerns, the Midday Break is unavailable to some community-impacting vocations. These include putting asphalt or pouring concrete if they cannot wait until after the break.
“We look forward to continued cooperation between the Ministry of Human Resources and Emiratisation, private-sector companies, and community members to achieve our shared goals, enhance the leadership and competitiveness of the UAE labour market, and boost its efficiency, productivity, and attractiveness to local and international talent, all while improving workers’ wellbeing,” Al Nassi continued.
During Midday Break or while doing jobs exempt from this rule, employers must provide workers with shaded areas and shades to protect them from direct sunlight. Work sites must also have enough water, drinking water, cooling devices (fans), hydrating materials (salts and other food items approved by UAE authorities), and first aid supplies.
Through inspection tours and community reports via its contact center at 600590000, website, or smart app, MoHRE will monitor company compliance with the Midday Break prohibition.
Companies in breach face penalties of AED5,000 per worker during Midday Break and up to AED50,000 for multiple workers.
The Ministry will also start awareness programs and field visits to work sites with its partners to educate workers and employers about the Midday Break during its enforcement period.
